Proposed improvements in e-way bill generation w.e.f 16.11.2018

  1. Checking of duplicate generation of e-way bills based on same invoice number : The e-way bill system is enabled in a way that if the consignor has generated one e-way bill on the particular invoice, then he or consignee or transporter will not be allowed to generate one more e-way bill on the same invoice number. If the transporter or consignee has generated one e-way bill on the consignor’s invoice, then if any other party (consignor, transporter or consignee) tries to generate the e-way bill, the system will alert that there is already one e-way bill for that invoice, and further it allows him to continue, if he wants.
  2. CKD/SKD/Lots for movement of Export/Import consignment : CKD/SKD/Lots supply type can now be used for movement of the big consignment in batches, during Import & Export also. Delivery challan and tax invoice need to accompany goods as prescribed in Rule 55 (5) of CGST Rules, 2017.
  3. Shipping address in case of export supply type : For Export supply type, the ‘Bill To’ Party will be URP or GSTIN of SEZ Unit with state as ‘Other Country’ and shipping address and PIN code can be given as the location (airport/shipping yard/border check post/ address of SEZ), from where the consignment is moving out from the country.
  4. Dispatching address in case of import supply type : For Import supply, the ‘Bill From’ Party will be URP or GSTIN of SEZ Unit with state as ‘Other Country’ and dispatching address and PIN code can be given as the location (airport/shipping yard/border check post/ address of SEZ), from where the consignment is entering the country.
  5. Enhancement in ‘Bill To – Ship To’ transactions : EWB generation is now categorized to four types now Regular and Bill to Ship to, Bill from Dispatch from & combination of both.
  6. Changes in Bulk Generation Tool : Facility of EWB generation through the Bulk Generation Tool has been enhanced.

Free or complimentary tickets given by franchise owners for IPL matches will attract Goods and Services Tax (GST), the Authority for Advance Ruling (AAR) said.

In response to an application filed by K P H Dream Cricket Pvt Ltd, which owns and operates IPL cricket team Kings XI Punjab, the Punjab bench of the AAR has ruled that providing complimentary tickets free of charge would be considered supply of service and therefore leviable to tax.
 
The GST rate on the sale of IPL tickets is 18 per cent.
 
The AAR also ruled that K P H Dream Cricket would be eligible to claim input tax credit (ITC) on taxes paid for such complementary tickets only to the extent of input and input service for such tickets.

The AAR said when the applicant issues a 'complimentary ticket' to any person, the applicant is "certainly displaying an act of forbearance by tolerating persons who are receiving the services provided by the applicant without paying any money, which other persons not receiving such complimentary tickets would have to pay for".
 
Stating that the complementary tickets given by K P H Dream Cricket to various persons would certainly be covered by the term 'token' and 'voucher', the AAR said as per GST laws the monetary value of "forbearance would naturally be pegged to the amount of money charged from other persons not receiving the 'complementary tickets' for availing the same services."
 
"The applicant has clearly missed the import of clause (b) in the definition of 'Consideration' given in section 2(31) of the CGST Act, 2017 which certainly covers the activity of the applicant of giving 'complementary tickets' to certain persons in the furtherance of his business and would thus be covered under scope of supply defined in Section 7(1)(a) of the CGST Act, 2017," the AAR said.
 
Commenting on the order, EY Tax Partner Abhishek Jain said: "A levy of GST on free supply of services to unrelated parties is not envisaged under the GST law. The ruling is against the no GST position adopted by the industry on such transactions".

IGST, Cess Exemption To Export Units, Software Parks Extended Till March 2019

The finance ministry has extended the exemptions granted to Export Oriented Units and Software Technology Parks of India from payment of the Integrated Goods and Service Tax and compensation Cess by six months till March 31, 2019.

The IGST and cess exemption to EOUs and STPI was scheduled to come to an end on Sept, 30.

Through a notification, the Central Board of Indirect Taxes and Customs said that taxes would be levied on these units under the GST ambit with effect from April 1, 2019.

Government notifies new annual return form for GST - Jammu & Kashmir

The government has notified a new return form for goods and services tax (GST) that will have to filed for the full year. 

The normal taxpayers will need to file GSTR-9 return form while composition taxpayers will have GSTR-9A. The last date for filing the annual return form for 2017-18 is December 31.
